Email Communication and Newsletter Consent: By submitting this form or signing up through the barristerbrewingco.com webiste I consent to receive electronic communications from Barrister Brewing Co, including newsletters, promotional emails, Membership communications, event notices, and other marketing or informational messages. I understand that such communications may be sent using automated or electronic means to the email address that I provide. I acknowledge that I may withdraw my consent to receive marketing emails at any time by using the unsubscribe link included in any email or by contacting Barrister Brewing Co directly. I understand that withdrawal of consent will not affect transactional or administrative communications relating to memberships, purchases, reservations, or other business dealings. Barrister Brewing Co intends to comply with all applicable electronic messaging laws, including the United States CAN-SPAM Act and Michigan Unsolicited Commercial Email Protection Act.
Membership Terms and Acceptance: If I enroll in or purchase any Barrister Brewing Co membership, club, mug club, loyalty program, or similar offering (“Membership”), I acknowledge that such Membership is subject to additional terms, benefits, limitations, and conditions established by Barrister Brewing Co. By purchasing, enrolling in, or using any Membership I agree to be bound by all Membership terms that are then in effect, which terms may be modified at any time with or without prior notice of Barrister Brewing Co. I understand that Memberships are personal to the member, non-transferrable unless expressly permitted by Barrister Brewing Co by way of the Membership policy in force at the time of the requested transfer, and may require presentation of identification and proof of membership.
Use of Name: By submitting this form or signing up through the barristerbrewingco.com website I acknowledge that Barrister Brewing Co may use my name in any and all of its publications, including web-based publications, without payment or other consideration. I hereby irrevocably authorize Barrister Brewing Co to edit, alter, copy, exhibit, publish, or distribute materials that include my name for any lawful purpose. In addition, I hereby waive any right to inspect or approve the finished product wherein my name appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my name in any of Barrister Brewing Co’s publications, including web-based publications. I hereby hold harmless, release, and forever discharge Barrister Brewing Co from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
Use of Images or Likenesses: By submitting this form or signing up through the barristerbrewingco.com website I hereby grant Barrister Brewing Co permission to use my likeness in any photograph, video, or other digital media in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photographs, videos, or other digital media will become the sole and exclusive property of Barrister Brewing Co. I hereby irrevocably authorize Barrister Brewing Co to edit, alter, copy, exhibit, publish, or distribute these photographs, videos, or other digital media for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of photographs, videos, or other digital media that may include my likeness. I hereby hold harmless, release, and forever discharge Barrister Brewing Co from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
No Cancellation or Refunds on Memberships: I understand and agree that all Membership fees, dues, or payments made to Barrister Brewing Co are final and non-refundable. Memberships may not be canceled mid-term and no prorated refunds, credits, or exchanges will be provided for unused benefits, voluntary termination, relocation, schedule changes, or any other reason not expressly approved in writing by Barrister Brewing Co.
Reservation of Rights to Modify Terms and Conditions and Memberships: Barrister Brewing Co reserved the right at any time and in its sole discretion to modify, amend, suspend, or terminate these Terms and Conditions, any Membership program, or any Membership benefits, pricing, eligibility requirements, or duration. I understand that updated Terms and Conditions or Membership terms may be posted on Barrister Brewing Co’s website or otherwise communicated electronically and will become effective upon posting or notice. Continued participation in any Membership or continued use of Barrister Brewing Co services after such changes constitutes acceptance of the modified terms.
User Conduct and Acceptable Use: I agree that when participating in any Barrister Brewing Co membership, event, premises activity, online platform, or communications channel I will act lawfully and respectfully. I will not engage in harassment, discrimination, abusive behavior, unlawful activity, fraudulent conduct, misuse of Membership benefits, or any conduct that interferes with the operations, staff, patrons, or reputation of Barrister Brewing Co. Barrister Brewing Co reserves the right, in its sole discretion, to suspend or terminate memberships, refuse service, remove individuals from its premises or events, or restrict participation without refund for violation of this policy, for violation of applicable rules, or for any reason whatsoever.
Intellectual Property: I acknowledge and agree that all trademarks, logos, branding, designs, text, images, graphics, menus, beer names, product names, publications, website content, social media content, and/or any other materials created or used by Barrister Brewing Co are and shall remain the sole and exclusive intellectual property of Barrister Brewing Co. Nothing in these Terms and Conditions or in any Membership grants me any ownership rights or license to use Barrister Brewing Co intellectual property except for personal, non-commercial participation in authorized Membership benefits. Any unauthorized reproduction, distribution, commercial use, or modification of any intellectual property of Barrister Brewing Co is prohibited without prior written consent of Barrister Brewing Co.
Data Protection and Privacy: I understand that Barrister Brewing Co may collect, store, and use personal information that I provide, including my name, contact information, Membership status, purchase history, and participation data, for purposes including Membership administration, communications, marketing, legal compliance, and business operations. Barrister Brewing Co will take commercially reasonable measures to protect personal information and wil not sell personal data to third parties for their independent marketing use. Personal information may be shared with service providers or processors acting on behalf of Barrister Brewing Co or where required by law but only to the extent necessary to allow the service provider or processor to provide its services or to the extent required by law. By submitting this form, I consent to such collection, use, storage, and processing of my information consistent with these Terms and Conditions and any applicable privacy policy of Barrister Brewing Co.
Limitation of Liability: To the fullest extent permitted by law, I hereby release, waive, and hold harmless Barrister Brewing Co, its owners, members, managers, officers, employees, agents, contractors, affiliates, successors, and assigns from any and all claims, liabilities, damages, losses, costs, or expenses of any kind, whether direct, indirect, incidental, consequential, or otherwise, arising out of: my participation in a Membership or event; my use of Barrister Brewing Co premises, services, or products; my reliance on communications or publications; modification or termination of Membership or benefits; my receipt of communication, marketing, promotion, or newsletter correspondence from Barrister Brewing Co; the use of my image, likeness, or name by Barrister Brewing Co; or any act or omission of Barrister Brewing Co to the extent permitted by law. I understand that this limitation includes, without limitation, claims for personal injury, property damage, economic loss, emotional distress, or loss of enjoyment, except where caused by gross negligence or willful misconduct to the extent such waiver is not permitted under applicable law.
Governing Law: These Terms and Conditions, all Membership terms, and any dispute or claim arising from or relating to Barrister Brewing Co, its services, or Memberships shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict-of-laws principles. I agree that any legal action shall be brought exclusively in a court of competent jurisdiction located in Shiawassee County, Michigan.
Entire Agreement: These Term and Conditions, together with any applicable Membership terms and privacy policy, constitute the entire agreement between me and Barrister Brewing Co regarding the subject matter herein and supersedes all prior or contemporaneous understandings or communications.
Acceptance of Terms and Conditions: By clicking the acknowledgement checkbox on any Barrister Brewing Co form or by signing up through the barristerbrewingco.com website I acknowledge the following: I HAVE READ AND UNDERSTAND THE ABOVE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE AND COMPETENT TO MAKE A KNOWING AND UNDERSTANDING WAIVER OF RIGHTS. I AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AS WELL AS ANY APPLICABLE MEMBERSHIP TERMS.
